WhatsApp CRM Platform

1. Introduction
Techno-Bot Technologies Pvt. Ltd. ("Company", "we", "us", or "our"), a company incorporated under the laws of India, operates a WhatsApp CRM platform ("Service") that enables businesses to manage customer interactions via the WhatsApp Business API provided by Meta Platforms, Inc.
This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service. It also describes the choices available to you regarding your information and how you can access and update that information.
By accessing or using our Service, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy. If you do not agree, please discontinue use of our Service immediately.
2. Definitions
For the purposes of this Privacy Policy:
• "Personal Data" means any information that identifies or can identify a natural person.
• "User" refers to any individual or business entity that accesses or uses our WhatsApp CRM platform.
• "End Customer" refers to the customers of our Users who interact with our Service through WhatsApp.
• "Meta / WhatsApp" refers to Meta Platforms, Inc. and its subsidiaries, including WhatsApp LLC.
• "Processing" means any operation performed on Personal Data, including collection, storage, use, disclosure, or deletion.
3. Information We Collect
We collect the following categories of information through our WhatsApp CRM platform:
3.1 Account & Business Information
• Business name, address, and GST / tax identification number
• Authorized representative name, email address, and phone number
• WhatsApp Business Account (WABA) ID and associated phone numbers
• Meta App credentials and API access tokens provided during integration
3.2 Customer Interaction Data
• WhatsApp phone numbers of End Customers who message your business
• Message content (text, media, documents) exchanged through the CRM
• Timestamps, delivery receipts, and message status metadata
• Labels, tags, notes, and conversation history added by your team
3.3 Usage & Technical Data
• Browser type, IP address, device identifiers, and operating system
• Pages viewed, features used, session duration, and clickstream data
• API request logs, error logs, and performance metrics
• Cookies and similar tracking technologies (see Section 9)
3.4 Data Obtained via Meta Platform
As a Meta Tech Provider / Business Solution Provider, we receive data through the WhatsApp Business API and Meta Graph API. This includes webhook payloads, user profile information shared via WhatsApp (such as profile name and phone number), and conversation metadata. We process this data strictly in accordance with Meta's Platform Terms and our agreements with Meta.
4. How We Use Your Information
We process your information for the following purposes:
• To provide, operate, and maintain our WhatsApp CRM Service
• To authenticate users and authorize access to the platform
• To send and receive WhatsApp messages on behalf of your business
• To store and display conversation histories, CRM records, and analytics
• To process billing, invoicing, and payment transactions
• To send transactional notifications, product updates, and support communications
• To detect, investigate, and prevent fraudulent, unauthorized, or illegal activity
• To comply with applicable legal obligations under Indian law and Meta's policies
• To improve the platform through aggregated, anonymized usage analytics
5. Legal Basis for Processing
We process Personal Data on the following legal bases:
• Contractual Necessity: Processing required to fulfill our agreement with you (our Terms of Service).
• Legitimate Interests: Processing necessary for fraud prevention, platform security, and service improvement, where these interests are not overridden by your rights.
• Consent: Where you have provided explicit consent (e.g., marketing communications). Consent may be withdrawn at any time.
• Legal Obligation: Processing required to comply with applicable Indian laws, regulations, or orders of competent authorities.
6. WhatsApp Business API & Meta Platform Compliance
Our Service integrates with the WhatsApp Business API. As a result:
• All WhatsApp messaging is subject to Meta's Terms of Service, WhatsApp Business Terms, and WhatsApp Commerce Policy.
• We do not share Personal Data obtained through Meta's platform with third parties in a manner that violates Meta's Platform Terms.
• We do not use WhatsApp message data to train machine learning models or for advertising profiling.
• End Customers who message your business through WhatsApp have opted into communication per WhatsApp's own Terms of Service. We do not initiate contact with End Customers without explicit consent.
• Meta may independently collect data from End Customers pursuant to its own Privacy Policy, over which we have no control.
Our privacy policy URL is publicly accessible, non-geoblocked, and crawlable by Meta as required by Meta Platform Terms Section 4.
7. How We Share Your Information
We do not sell, rent, or trade your Personal Data. We may share information in the following circumstances:
7.1 Service Providers
We engage trusted third-party vendors to support our operations, including cloud hosting (AWS / Google Cloud), payment processors, and customer support tools. These vendors process data only on our documented instructions and are bound by data processing agreements.
7.2 Meta Platforms
Data is transmitted to Meta as part of normal WhatsApp Business API operation (e.g., delivering messages). Meta processes this data under its own Privacy Policy.
7.3 Legal Disclosures
We may disclose your information where required by Indian law, court order, or government authority, including under the Information Technology Act, 2000, the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, or successor legislation.
7.4 Business Transfers
In the event of a merger, acquisition, or sale of assets, your information may be transferred. We will provide notice before your Personal Data is transferred and becomes subject to a different privacy policy.
8. Data Retention
We retain your data for as long as your account is active or as needed to provide the Service, and for a period thereafter as required to comply with legal obligations, resolve disputes, and enforce our agreements. Specifically:
• Account data: Retained for the duration of the contract plus 3 years.
• WhatsApp conversation data: Retained for up to 12 months from date of message, unless you request earlier deletion or a longer retention period is mandated by law.
• Billing records: Retained for 7 years as required under the Companies Act, 2013 and GST regulations.
• Log data: Retained for 90 days for security and debugging purposes.
9. Cookies and Tracking Technologies
Our web platform uses cookies and similar technologies to:
• Maintain your authenticated session
• Remember your preferences and settings
• Analyze aggregate platform usage via analytics tools
You may control cookie settings through your browser. Disabling certain cookies may affect platform functionality. We do not use cookies for behavioral advertising.
10. Data Security
We implement appropriate technical and organizational measures to protect your Personal Data, including:
• TLS/HTTPS encryption for all data in transit
• AES-256 encryption for sensitive data at rest
• Role-based access controls and audit logging
• Regular security assessments and vulnerability scanning
• Employee training on data protection and confidentiality obligations
No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your Personal Data, we cannot guarantee absolute security. In the event of a data breach that poses a risk to your rights, we will notify you in accordance with applicable Indian law.
11. Your Rights
Subject to applicable law, you have the following rights with respect to your Personal Data:
• Right to Access: Request a copy of the Personal Data we hold about you.
• Right to Correction: Request that we correct inaccurate or incomplete data.
• Right to Deletion: Request deletion of your Personal Data (see Section 12).
• Right to Restrict Processing: Request that we limit how we use your data.
• Right to Data Portability: Receive your data in a structured, commonly used format.
• Right to Withdraw Consent: Withdraw consent at any time where processing is based on consent.
To exercise any of these rights, please contact us using the details in Section 13. We will respond within 30 days of receiving a verifiable request.
12. Data Deletion Requests
You have the right to request deletion of your Personal Data. To submit a deletion request:
• Email us at: privacy@technobot.tech with the subject line "Data Deletion Request"
• Include your registered email address, business name, and WhatsApp Business Account ID
• We will verify your identity and process the request within 30 days
Please note that we may be required to retain certain data to comply with legal obligations, resolve disputes, or enforce our agreements. Where deletion is not technically possible (e.g., backups), we will isolate and protect the data from further processing.
For Meta-related data deletion requests, you may also use the data deletion callback mechanism configured in your Meta App Dashboard.
13. Children's Privacy
Our Service is intended for businesses and is not directed at individuals under the age of 18. We do not knowingly collect Personal Data from minors. If you believe we have inadvertently collected such data, please contact us immediately and we will take steps to delete it.
14. International Data Transfers
Our servers are primarily located in India. If data is transferred outside India (e.g., to Meta's servers in the United States), such transfer will be governed by appropriate safeguards such as Standard Contractual Clauses or other mechanisms recognized under applicable Indian data protection law.
15. Third-Party Links
Our platform may contain links to third-party websites. We are not responsible for the privacy practices of those sites. We encourage you to review the privacy policies of any third-party sites you visit.
16. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. When we make material changes, we will:
• Post the updated policy on our website with a new Effective Date
• Send an email notification to the registered email address on your account
• Display an in-app banner for a period of 30 days after the update
Your continued use of the Service after the effective date of the updated policy constitutes your acceptance of the changes.
17. Governing Law
This Privacy Policy is governed by the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 (DPDPA), and all applicable rules and regulations thereunder. Any disputes shall be subject to the exclusive jurisdiction of the courts in Tamil Nadu, India.
